1. Acceptance of Terms
By accessing or using MSG25 ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to modify these terms at any time with notice via email or dashboard notification.
2. Service Description
MSG25 provides SMTP relay services for transactional and marketing emails. The Service includes email sending, delivery tracking, analytics, and related tools. We do not guarantee 100% delivery rates as email delivery depends on many factors including recipient server policies.
3. Account Responsibilities
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access
- You must be at least 18 years old to use the Service
4. Prohibited Uses
You may NOT use the Service to:
- Send unsolicited bulk email (spam)
- Send phishing emails or emails impersonating others
- Distribute malware, viruses, or harmful content
- Send emails to purchased, rented, or scraped lists
- Violate any applicable laws or regulations
- Send emails containing illegal content
- Attempt to bypass rate limits or abuse detection systems
- Resell the Service without authorization
5. Payment Terms
- Pay-as-you-go credits are non-refundable and do not expire
- Lifetime deals are one-time payments for perpetual access at stated limits
- Monthly subscriptions are billed in advance and auto-renew
- All prices are in USD unless otherwise stated
- We reserve the right to change pricing with 30 days notice
6. Refund Policy
15-Day Refund Window
Refunds are available within 15 days of purchase, subject to the following conditions:
- No violation of Terms of Service or Anti-Spam Policy
- No abuse, phishing, or spam activity detected
- Less than 20% of plan quota has been used
- Account has not been suspended for policy violations
Refunds are NOT available if your account has been terminated for abuse or policy violations.
7. Service Level
We target 99.9% uptime for the SMTP relay service. Scheduled maintenance windows are excluded. We do not provide SLA credits at this time. Service availability statistics are available on our status page.
8. Account Suspension & Termination
We may suspend or terminate your account if:
- You violate these Terms or the Anti-Spam Policy
- Your email activity generates excessive complaints or bounces
- We detect fraudulent or abusive behavior
- Required by law or legal process
You may terminate your account at any time from your dashboard. Unused credits or subscription time are not refunded upon voluntary termination.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MSG25 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless MSG25 and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Governing Law
These Terms shall be governed by the laws of the jurisdiction where MSG25 is incorporated, without regard to conflict of law principles.
